The Statement of Claim was filed on July 20, 2017. BDO Canada LLP delivered a Notice of Intent to Defend on November 29, 2017.
The parties attended an early stage mediation. No settlement was reached.
The certification motion was heard by the Honourable Justice Paul Perell on December 9 and 10, 2019. On January 8, 2020, the Court released its decision denying certification of the class action. We appealed the Court’s decision to the Ontario Divisional Court. The appeal was heard by the Divisional Court on February 1, 2021. The Divisional Court released its decision on April 20, 2021 dismissing the appeal. We sought leave to appeal the Divisional Court’s decision to the Ontario Court of Appeal. The Ontario Court of Appeal released its decision on October 4, 2021 denying leave to appeal. We sought leave to appeal to the Supreme Court of Canada, which was denied on April 14, 2022. Accordingly, the Courts have finally determined that the class action shall not be certified.
