With a practice spanning Canada and the US, Simon focuses on commercial and corporate litigation, directors’ and officers’ liability, securities litigation, class actions, and professional negligence. Simon represents a broad range of clients, including various regulated professionals, directors and officers, oppressed shareholders, and public and private companies.
Simon delivers results, both in and out of the courtroom. He has a robust trial and appellate practice, appearing regularly at all levels of court in Ontario and Canada-wide, as well as administrative tribunals in Ontario, British Columbia, Alberta, Saskatchewan, and Manitoba regulating securities and capital markets, accountants, and lawyers. Simon also regularly mediates and arbitrates commercial matters, typically involving the interpretation of commercial agreements, price adjustments and disputes over fair value.
Simon’s excellence in advocacy is consistently recognized by his peers and leading legal publications. In 2019, Lexpert named Simon one of Canada’s leading lawyers under 40. That same year he was invited to become a Fellow of the Litigation Counsel of America, an honour extended to less than one-half of one percent of North American lawyers, recognizing excellence in trial advocacy. Chambers has in all years since 2019 recognized Simon’s expertise in commercial litigation and Benchmark has similarly ranked him a “Litigation Star”. Lexpert and Best Lawyers consistently recognize Simon’s expertise in corporate commercial litigation, directors’ and officers’ liability, securities litigation, arbitration and international arbitration, regulatory and public law, and professional liability.
Simon is on the Board of the Directors of the Advocates’ Society, and is a Member of the Securities Proceedings Advisory Committee of the Ontario Securities Commission. He participated in the Litigation Assistance Program which offered pro bono representation to respondents in proceedings at the Ontario Securities Commission (now, Capital Markets Tribunal). Simon is regularly invited to present at legal seminars and conferences, particularly on securities litigation and directors’ and officers’ liability. Simon is the co-author of a text published by LexisNexis titled Directors’ and Officers’ Liability in Canada, which he is presently updating with a colleague.
Simon graduated from the University of Memphis School of Law in 2005 with its gold medal. Before co-founding Adair Goldblatt Bieber LLP, Simon worked in the litigation department of Stikeman Elliott LLP and was the managing partner of Wardle Daley Bernstein Bieber LLP.
